MI Blood Alcohol Content Bill Passes Committee

Passing committee, House Bill 4548 would extend, for five more years—until October 1, 2023—the provision within the Michigan Vehicle Code establishing 0.08 BAC as the per se level for drunk driving. On October 1, 2018, the 0.08 BAC per se level is scheduled to revert to 0.10 BAC. Under the state’s per se statute (or presumptive level for determining if a person is guilty of drunk driving), a person with a blood alcohol content (BAC) of 0.08 percent is considered to be operating while intoxicated and is guilty of drunk driving.
