The Kentucky Beer Wholesalers Association (KBWA) has sued the Kentucky Department of Alcoholic Beverage Control (ABC) in Circuit Court over an advisory opinion issued with respect to a microbrewery’s ability to ship and deliver malt beverages that it produces directly to consumers via common carrier. The ABC’s advisory affirmed that ability, however, the KBWA claims that the advisory s in direct conflict with applicable Kentucky law. The Kentucky Guild of Brewers, which originally requested the ABC opinion, has also been names in the wholesalers’ suit.
