House Bill 328 creates a category of “spirits infused refreshments” defined as a single-serve beverage containing liquor, packaged in a can or an approved container no larger than 16 ounces and which contains no more than 10 percent alcohol by volume. Taxed at the beer rate, such products would be distributed like beer.
