A federal judge has found that Ohio distributor Bobby Fisher, Inc. must refund almost $77,000 to Cerveceria Costa Rica (CCR) for the diminished value of North American Breweries brands the supplier terminated in 2013 under the successor manufacturer provisions of Ohio franchise law. The distributor originally received over half a million dollars for the brands, but sued in court for greater value, only to have the court find that a refund was in order. Citing the highly speculative nature of Bobby Fisher’s value calculations, the court undertook its own value determination in reaching its decision.
