An Idaho District Court has ruled against a challenge by distributors that ABI’s ownership of 10 Barrel’s Boise brewpub was contravened by a state law that prohibited a brewer producing in excess of 30,000 barrels a year from holding a retail license. The court found the determining factor to be that the local entity is operating under the statutory provisions, thereby making the financial interest in that entity immaterial.
