Independent Craft Brewer Seal API Access

Thank you for your interest in using the independent craft brewer data set and BREWERS ASSOCIATION CERTIFIED INDEPENDENT CRAFT certification mark (or seal) to show which breweries are certified independent craft brewers.

Please review and agree to the terms below, then complete the form to submit your request for access to the list of breweries that are certified small and independent and qualify for the BREWERS ASSOCIATION CERTIFIED INDEPENDENT CRAFT seal. Brewers Association staff will review your request and you will receive a reply within 10 business days.


TERMS & CONDITIONS

Brewers Association (“BA”) makes available a data set of certified independent craft brewers and provides and Application Programming Interface (the “API”) to permit third party websites and applications to access this data set. By requesting use of the API, access to the independent craft brewer data set and BREWERS ASSOCIATION CERTIFIED INDEPENDENT CRAFT seal (the “Seal”) on my website or app and by using the Seal, I agree to the following terms and conditions:

  • I will only use the API and the Seal in connection with websites, apps and related digital properties under my control that identify breweries that the Brewers Association has certified as independent craft breweries. I understand that a brewery that qualifies for the Seal meets the Brewers Association’s craft brewer definition and holds a valid TTB Brewer’s Notice.
  • I understand that I cannot use the Seal in connection with any cached data, and my website/app/digital platform must refresh at least every 24 hours. I understand that I will have access to the most up-to-date list through the BA-provided API.
  • I understand that BA may monitor my use of the API and Seal in order to verify my compliance with these terms and to assess the quality of the websites, apps and related digital properties under my control.
  • I will not use the Seal in connection with the products or branding of non-qualifying, non-certified independent craft breweries (or any other breweries that do not meet the Brewers Association’s certification criteria).
  • I agree that I will include the Seal in my application and/or on my website next to the name of breweries and brands of craft brewers as listed in the API. If displaying the Seal in this way is not possible in my application and/or on my website, then I agree to include the Seal prominently in my application or on my website, along with the following text: “This [website or application] supports independent craft brewers.”
  • This agreement covers use of the Seal only for the digital property as described in this application. I understand that I cannot use the Seal for any other purpose (including, for example, use in print or on merchandise) without BA’s prior written consent.
  • I understand that BA has the right to revoke access to and/or use of the Seal at any time. I agree that BA owns all right, title and interest in and to the BREWERS ASSOCIATION CERTIFIED INDEPENDENT CRAFT Seal and all associated names and logos and controls their use.
  • I agree to notify BA immediately in the event that I become aware of any violation of any provision of these terms. BA may suspend my access to the API without notice if BA believes in its sole discretion that I am in violation of these terms or that use of the API is unauthorized, presents a security threat, is for obscene, offensive, harassing or fraudulent purposes or interferes with others’ appropriate use of the API. Without limiting the foregoing suspension rights, I understand that BA may terminate access to the API if I fail to remedy any such issue within 30 days of notice.
  • I agree to use best efforts to ensure that my use of the API will not generate excessive load on BA’s systems or cause BA’s systems to behave inaccurately or inconsistently. I will not corrupt or modify the data set provided by BA or use superseded or unauthorized versions of the API, including (without limitation) for the purpose of obtaining unauthorized access to BA’s systems.
  • BA may suspend access to or shut down the API entirely at any time in order to fix problems with the API, conduct routine maintenance, update the API, or for any other reason.
  • I will not and will not enable or allow my website or application(s) or any other person or entity to: (a) reverse engineer, disassemble, decompile or otherwise attempt to derive the source code or the underlying ideas, algorithms, structure or organization of BA’s systems; (b) lease, loan or sell the API; (c) create derivative works of or otherwise modify the API; (d) attempt to defeat, avoid, bypass, remove, deactivate or otherwise circumvent any software protection mechanisms in the API or BA’s systems, including (without limitation) any such mechanism used to restrict or control the functionality of any of the foregoing, or (e) disable, hack, disrupt, damage, interfere or otherwise access in an unauthorized manner BA’s system(s) or any technology or service of BA, or violate, tamper with, or circumvent the security of any computer network, software, passwords, encryption codes or technological protection measures.
  • The API may be protected by copyrights, trademarks, service marks, international treaties, and/or other proprietary rights and laws of the U.S. and other countries. BA’s rights apply to the API and all output and executables of the API, including any and all updates, enhancements, upgrades, improvements or derivative works thereof (collectively “API Enhancements”) or any output or executables of the API and API Enhancements. I agree to abide by all applicable proprietary rights laws and other laws, as well as any additional copyright notices or restrictions contained in these Terms. BA owns all right, title, and interest in and to the API and the API Enhancements and to all associated worldwide intellectual property rights. I understand that these terms do not grant any right, title, or interest in any intellectual property owned or licensed by BA, including (but not limited to) the API or API Enhancements and the Seal.
  • I agree to refrain from any actions that would obscure the BA brand or copyright notices contained on any materials, including but not limited to: (i) covering up or “layering over” the BA logo or Seal; or (ii) removing or modifying any copyright or trademark notice, or other notice of ownership without the express written consent of BA. All code samples must contain appropriate copyright notice. Further, the BA name may not be used to endorse or promote your products or applications without the express written consent of BA.
  • The API is provided on an “as is” basis. BA, on behalf of itself and its affiliates, to the fullest extent permitted by law, disclaims all warranties, express, implied, statutory or otherwise, including (without limitation) any implied warranties of merchantability, non-infringement of third parties’ rights, and fitness for a particular purpose.
  • BA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THE API, INCLUDING (WITHOUT LIMITATION): (a) MY USE OF OR INABILITY TO USE THE API OR DATA SETS OR (b) ANY LACK OF AVAILABILITY OF OR INACCURACY OF ANY DATA OBTAINED THROUGH MY USE OF THE API.
  • I agree, at my expense, to indemnify and hold BA and its affiliates harmless from and against any and all losses, costs, damages, liabilities, and expenses (including, without limitation, attorneys’ fees) arising out of or relating to third party claims, actions, or allegations based on my websites and applications, my use of the API, and any data sets accessed by me or my products through the API.
  • BA welcomes and appreciates your assistance in identifying any misuse of the Seal in the marketplace.
