The Alcohol and Tobacco Tax and Trade Bureau (TTB) has issued a final rule, effective January 10, 2025, that changes the “standards of fill” (permitted consumer packages) for wine and distilled spirits. The new rule authorizes a total of 28 additional standards of fill (13 for wine containers and 15 for distilled spirits containers). The rule also removes the distinction between standards of fill for distilled spirits in cans vs. other packaging.
For wine, the following standards of fill may now be used: “180, 300, 330, 360, 473 (16 oz.), 550, 568 (19.2 oz), 600, 620, 700, and 720 milliliter sizes and 1.8 and 2.25 liter sizes. These are in addition to those that had already been approved and listed in 27 CFR 4.72.”
For distilled spirits, the following standards of fill may now be used: “187, 250, 331, 350, 355, 475, 500, 570, 700, 710, and 945 milliliter sizes and 1.5, 2, 3, and 3.75 liter sizes. These are in addition to those that had already been approved and listed at 27 CFR 5.203. All standards of fill for distilled spirits are now approved for cans and containers other than cans.”
The final rule will impact members making non-beer products, particularly by authorizing the 16 oz. and 19.2 oz. size for wine (including hard cider containing 7% alcohol by volume or greater), and very close size analogs for spirits. Brewers packaging spirits in cans may wish to explore whether existing 16 and 19.2 oz. can sizes can be used to meet the newly-authorized 475 ml and 570 ml fill sizes through adjustments to fill levels.
