The Alcohol and Tobacco Tax and Trade Bureau (TTB) recently closed the reopened comment period on its proposed rulemaking addressing standards of fill for wine and distilled spirits. TTB specifically proposed adding 10 additional authorized standards of fill for wine or, as an alternative, eliminating all but a minimum standard of fill for wine containers and all but a minimum and maximum for distilled spirits containers with the goal of potentially eliminating unnecessary regulatory requirements, reducing barriers to competition, and providing consumers broader purchasing options. The vast majority of comments submitted in the reopened comment period supported either complete elimination of standards of fill or the addition of several new package sizes to address innovation, competitive concerns, and consumer choice issues.
